Terms and Conditions
These terms cover your use of clubkick.com and everything you can buy or book through it: articles, training content, the newsletter, the shop, Online Coaching and Train With Jack. By using the site you accept them.
Who you are dealing with
clubkick.com is operated by Jack Folan. An Australian business registration is in progress and this page will be updated with the registered business name and ABN as soon as it is issued. In these terms, “we” and “Club Kick” mean that business, and “you” means the person using the site or buying from us.
Using the site
You may read the site, share links to it and use the training material for your own football, or for players you coach.
You may not republish our articles, videos or programmes as your own, sell or redistribute them, scrape the site, or use our content to build a competing product or to train an automated system, without our written permission.
Do not attempt to break, overload or gain unauthorised access to the site.
Accounts
You do not need an account to buy from us. If you create one, keep your login details private. You are responsible for what happens through your account. Tell us straight away if you think someone else has access.
Accounts are for people aged 18 and over. If you are under 18, ask a parent or guardian to buy or book on your behalf.
Our content and yours
The Club Kick name, logo, articles, videos, drills, programmes and site design belong to us and are protected by copyright and trade mark law.
When you buy a digital programme you get a personal licence to use it for your own football or with players you coach directly. You may not share the file, upload it anywhere or sell it on.
If you post a comment, keep it civil and on topic. No abuse, no spam, nothing illegal, nothing that is not yours to post. We can remove anything and block anyone. By posting you give us permission to display what you posted on the site. You keep ownership of it.
Training safely
The drills, sessions and programmes on Club Kick are general football coaching. They are not medical, physiotherapy or nutrition advice.
Train within your ability, warm up properly and stop if something hurts. Speak to a doctor before starting a new training programme, particularly if you are returning from injury or have a condition that training could affect.
If you are under 18, a parent, guardian or coach should know what you are doing and agree it is suitable for you.
Results
How much you improve depends on how much you practise, where you are starting from, your coaching environment and plenty of things outside our control. We do not promise any particular outcome, standard, selection, trial, scholarship or contract. Nothing on the site should be read as a guarantee of one.
Shop, orders and payment
Prices are shown on the product page in the currency stated and include GST where it applies. Prices and availability can change before you order.
Putting an item in your basket does not reserve it. Your order is an offer to buy. A contract is formed when we send you an order confirmation. If we cannot fulfil an order, for example because an item is out of stock or a price was listed in error, we will tell you and refund you in full.
Payment is taken at checkout by our payment provider. We do not store your card details.
Clothing sizing is shown on each product page. Measurements are a guide and can vary slightly between production runs. If you are between sizes, tell us before you order and we will help.
Delivery times and costs are set out on our Shipping page. Returns and refunds are covered by our Refunds and Returns Policy.
Digital programmes
Digital programmes are delivered as a download. The link appears on the confirmation page and is emailed to you at the same time. You do not need an account.
Before you buy, check that you can open a PDF and that the programme suits your age group and level. Each product page sets out what is included, how many sessions there are and what equipment you need.
Because a download cannot be returned once you have it, we do not offer change of mind refunds on digital programmes once the download has been accessed. This does not affect your rights under the Australian Consumer Law if a programme is faulty, does not match its description or is not as advertised. See Refunds and Returns.
Online Coaching
What you are buying. A training programme built for you, delivered remotely, together with the check ins described on the Online Coaching page at the time you book. The page sets out the length of the block, how many check ins are included and how they happen.
Payment. Payment is taken in full at the time you book unless we agree otherwise in writing.
Delivery. We will send your programme within five working days of receiving the information we need from you. If you do not send that information, we cannot start, and we will chase you once before pausing the block.
Check ins. Check ins happen at the times agreed with you. If you miss one without telling us, we will offer one alternative time. Beyond that, a missed check in is treated as used.
Rescheduling and cancellation. Tell us as early as you can and we will do our best to move things. If you cancel before the programme has been sent to you, we will refund you in full. If you cancel part way through a block, we will refund the part we have not yet delivered.
If we cancel. If we cannot deliver a block, you can take a replacement or have your money back.
Outcomes. Online Coaching is a programme and support, not a promise of a particular level, selection or opportunity.
Train With Jack
Train With Jack is one to one, in person coaching for players aged 8 to 16, held at a single venue in the Eastern Suburbs of Sydney. The exact meeting point is confirmed with your booking.
Jack holds a valid NSW Working With Children Check and is a UEFA C qualified coach.
Who books
Bookings must be made by a parent or guardian aged 18 or over, or by an adult with the authority of the parent or guardian. The adult who books is our customer and is responsible for payment, for the accuracy of what they tell us and for the arrangements around the session.
The session
A session lasts 45 minutes. The player should arrive ready to train, in suitable clothing and boots for the surface, with shin pads and a drink. We provide balls and equipment.
A parent, guardian or nominated adult must remain contactable for the whole session and must be present at drop off and collection. Please tell us before the session if anyone other than the person who booked will be collecting the player.
Late arrival
Sessions start and finish at the booked time. If a player arrives late, we will use the time that is left. We cannot run past the finish time because of the sessions that follow.
Rescheduling and cancellation
You can move or cancel a session up to 48 hours before the start time for a full refund or a new slot at no cost. Inside 48 hours we cannot offer a refund, because the slot is held for you and is unlikely to be filled. If something serious comes up, tell us and we will do what we reasonably can.
If we cancel or move a session for any reason, you can take another slot or have your money back in full.
Weather
Sessions run in most weather. We will cancel where it is genuinely unsafe, for example lightning, extreme heat, or a surface that cannot be used. If we cancel for weather you get a new slot or a full refund at no cost, and the 48 hour rule does not apply. If you choose not to attend on a day we are running, the normal cancellation terms apply.
Safety and responsibility
Football carries a risk of injury. We coach with reasonable care and skill and run age appropriate sessions, and Jack holds a valid NSW Working With Children Check. None of that removes the ordinary risk of playing sport.
Tell us before the session about anything that affects how a player should train, so we can plan around it. We will treat that information confidentially and keep it separately from the booking record.
We may stop a session early, without a refund, if a player behaves in a way that is unsafe to themselves or others, after a warning where it is safe to give one.
Photography and video
We do not photograph or film a player, or use anything from a session on our channels, unless the parent or guardian has given separate written permission. That permission is optional, it is never a condition of booking, and you can withdraw it at any time.
Outcomes
Sessions are coaching. They are not a trial, a pathway or a route to a club, and we do not promise selection or any other outcome.
Your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies those guarantees. If any part of these terms conflicts with them, the guarantees apply.
If you are a consumer in the United Kingdom or the European Union, you keep the protection of the mandatory consumer laws of the country you live in, and nothing here takes those away.
Liability
Subject to your consumer rights above, and to the extent the law allows:
- The site and its content are provided as they are. We do not promise the site will always be available or free of errors.
- We are not liable for loss that was not reasonably foreseeable, or for loss of profit, opportunity or data.
- Where we are liable for a service, our liability is limited to resupplying the service or paying the cost of having it resupplied, whichever we choose. For goods, it is limited to replacing them, supplying equivalent goods, or paying the cost of doing so.
Nothing in these terms limits liability that cannot legally be limited, including liability for death or personal injury caused by our negligence, or for fraud.
Other sites
We link to other sites and social platforms, and the site carries advertising served by Google. We do not control those sites or the advertisers and we are not responsible for their content or for what they do with your information. Their terms and privacy policies apply when you go there.
Changes to these terms
We may update these terms. The version on this page is the one that applies to new orders and bookings. The terms that applied when you placed an order continue to apply to that order.
Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction. If you are a consumer living somewhere else, you keep the protection of the mandatory laws of your own country and you can bring a claim there.
